THE preliminary hearing of the criminal case filed against "It's Showtime" hosts Vice Ganda (Jose Marie Viceral in real life) and Ion Perez for allegedly violating the cybercrime law will begin on Monday, November 13.
As a matter of course, the hearing will look at all the evidence and information presented by the Kapisanan ng mga Social Media Broadcasters ng Pilipinas Inc. (KSMBPI) in its complaint against the television host and Perez has been set at the Quezon City Prosecutor's Office.
The case is for violation of Article 201 of the Revised Penal Code (RPC), which prohibits obscene exhibitions and indecency in relation to Republic Act 10175, or the "Cybercrime Prevention Act of 2012," which declares criminal the propagation of "immoral doctrines, obscene publications and exhibitions, and indecent shows."
KSMBPI, represented by its president, lawyer Leo Olarte, is upbeat that there is sufficient evidence to bring the criminal complaint to court and that Vice Ganda and Perez, who are real-life partners, will be made accountable for their "obscene, explicit and indecent actions" during a live segment of the noontime variety show "It's Showtime" last July 25.
During the said TV show, Vice Ganda and Perez made explicit and indecent actions in front of minors who were taking part in the show's segment.
